Waste Collection Shoreditch Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Shoreditch provides waste collection and related services to residential, commercial and other customers. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a collection.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation or other entity that requests or receives waste collection or related services from Waste Collection Shoreditch.
Services means waste collection, removal, transportation, loading, clearance, recycling, and associated activities provided by Waste Collection Shoreditch.
Waste means any materials, items, goods, products, rubbish or refuse presented for collection as part of the Services, excluding prohibited and hazardous items as detailed in these Terms and Conditions.
Agreement means the contract between Waste Collection Shoreditch and the Customer incorporating these Terms and Conditions and any specific details confirmed in a booking.
2. Scope of Services
Waste Collection Shoreditch provides pre-booked waste collection services within its operational area, including general household waste, bulky items, light construction waste, commercial waste and recyclable materials, subject to applicable waste regulations and any restrictions in these Terms and Conditions.
The precise nature and extent of the Services will be confirmed at the time of booking. The Customer is responsible for ensuring that the description and estimated volume or weight of waste supplied during the booking process are accurate and complete.
3. Booking Process
3.1 Customers may request a booking by telephone, email, online form or any other method that Waste Collection Shoreditch may make available from time to time.
3.2 At the time of booking, the Customer must provide:
a. Full name or business name, contact details and collection address.
b. A description of the waste to be collected, including type, quantity, approximate weight and any special handling requirements.
c. Preferred collection date and time window.
3.3 Any quote provided before inspection is based on the information given by the Customer and is therefore an estimate only. Waste Collection Shoreditch reserves the right to amend the price if the waste type, volume or access conditions differ from those described at the time of booking.
3.4 The booking is only confirmed when Waste Collection Shoreditch issues a confirmation by email, text message, or verbal confirmation by telephone. Waste Collection Shoreditch reserves the right to refuse any booking at its discretion.
4. Service Access and Customer Obligations
4.1 The Customer must ensure that the collection point is safe, accessible and suitable for the Services to be carried out. This includes providing clear access for vehicles and operatives and ensuring that the waste is located in the agreed area.
4.2 The Customer is responsible for obtaining any permissions, permits or authorisations that may be required to carry out the Services at the collection location, including but not limited to access through communal areas or private land.
4.3 If operatives are required to enter premises, the Customer must ensure that the area is safe, free from hazards and that access does not breach any lease, tenancy, health and safety or building management rules.
4.4 Where parking is required for the collection vehicle, the Customer must either provide suitable off-street parking or arrange any necessary permits or pay-and-display tickets. Any parking fines or penalties arising directly from insufficient or incorrect parking arrangements caused by the Customer may be charged to the Customer.
5. Pricing and Payments
5.1 Prices for Services are generally based on one or a combination of the following: volume of waste, weight of waste, labour required, type of waste, and access conditions.
5.2 Waste Collection Shoreditch will provide the Customer with an estimated price prior to the collection date. The final price will be confirmed on site once the waste has been inspected. If the Customer does not agree to any change in price arising from a difference between the estimated and actual waste, the Customer may refuse the service, subject to any applicable call-out or cancellation charges as set out in these Terms and Conditions.
5.3 Payment is due on or before completion of the collection, unless otherwise agreed in writing. Waste Collection Shoreditch may require a deposit or full prepayment for certain bookings.
5.4 Accepted payment methods may include cash, debit card, credit card, bank transfer or other methods notified to the Customer. The Customer warrants that any payment method used is valid, authorised and has sufficient funds or credit.
5.5 For business Customers with agreed credit terms, invoices are payable within the timeframe stated on the invoice. Waste Collection Shoreditch reserves the right to charge interest and late payment fees in accordance with applicable UK legislation for overdue amounts.
6. Cancellations and Amendments
6.1 The Customer may cancel or amend a booking by contacting Waste Collection Shoreditch during normal business hours.
6.2 If the Customer cancels with at least 24 hours notice before the scheduled collection time, no cancellation fee will normally apply, unless otherwise specified at the time of booking.
6.3 If the Customer cancels within 24 hours of the scheduled collection, or fails to provide access for the collection to be carried out, Waste Collection Shoreditch reserves the right to charge a reasonable cancellation or call-out fee to cover costs incurred.
6.4 Any amendments to the booking, including changes to the date, time, address or estimated volume of waste, are subject to availability and may affect the price. Waste Collection Shoreditch will inform the Customer of any revised charges before proceeding.
6.5 Waste Collection Shoreditch reserves the right to cancel or reschedule a booking due to operational reasons, vehicle breakdown, staff illness, severe weather, unsafe access, or events beyond its reasonable control. In such cases, Waste Collection Shoreditch will use reasonable efforts to notify the Customer and arrange an alternative collection time. Waste Collection Shoreditch will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.
7. Waste Types and Regulations
7.1 Waste Collection Shoreditch operates in compliance with applicable UK waste management legislation and regulations. Waste will be transported and disposed of or recycled at authorised facilities in accordance with regulatory requirements.
7.2 The Customer is responsible for accurately describing the waste presented for collection and must not include any hazardous or prohibited materials unless explicitly agreed in writing and permitted under relevant regulations.
7.3 Prohibited items may include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, pressurised containers, certain electrical equipment containing hazardous components, radioactive materials, explosives and any other items classified as hazardous under UK law.
7.4 If hazardous or prohibited waste is discovered during or after collection which was not disclosed at the time of booking, Waste Collection Shoreditch may:
a. Refuse to collect the items in question.
b. Charge additional fees for handling, transport and disposal if such waste can be legally and safely managed.
c. Return the waste to the Customer or require the Customer to arrange appropriate specialist removal.
7.5 The Customer shall indemnify Waste Collection Shoreditch for any loss, damage, cost, fine or liability arising from the inclusion of undisclosed hazardous or prohibited materials in the waste presented for collection.
8. Service Performance and Timeframes
8.1 Waste Collection Shoreditch will use reasonable care and skill in providing the Services and will endeavour to attend within the agreed time window. However, any times given for arrival or completion are estimates only and are not guaranteed.
8.2 The Customer acknowledges that delays may occur due to traffic, weather, earlier jobs over-running, access issues or other circumstances beyond the reasonable control of Waste Collection Shoreditch. Waste Collection Shoreditch will not be liable for any losses arising from such delays, provided that it acts with reasonable diligence to perform the Services as soon as practicable.
9. Liability and Damage
9.1 Waste Collection Shoreditch will take reasonable care when carrying out the Services. However, the Customer acknowledges that movement of heavy items, waste and equipment carries some risk of minor damage, particularly to paintwork, flooring, door frames and similar surfaces.
9.2 Waste Collection Shoreditch will not be liable for:
a. Normal wear and tear or superficial marks caused by the reasonable performance of the Services.
b. Any pre-existing damage or defects to property, items or premises.
c. Loss or damage arising from inaccurate information or instructions provided by the Customer.
9.3 In the event that Waste Collection Shoreditch is found liable for loss or damage to property, such liability will be limited to the reasonable cost of repair or replacement of the damaged item or area, taking into account age, condition and fair wear and tear, and subject to any applicable exclusions in these Terms and Conditions.
9.4 Waste Collection Shoreditch does not exclude or limit liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be excluded.
9.5 Subject to the paragraph above, Waste Collection Shoreditch shall not be liable for any loss of profit, loss of business, loss of goodwill, loss of opportunity or any indirect or consequential loss arising out of or in connection with the Services or these Terms and Conditions.
10. Customer Property and Ownership of Waste
10.1 By presenting waste for collection, the Customer confirms that they are the owner of the items or have the full authority of the owner to dispose of them.
10.2 Ownership of the waste transfers to Waste Collection Shoreditch at the point of loading into the collection vehicle, subject to compliance with waste regulations and these Terms and Conditions.
10.3 Waste Collection Shoreditch reserves the right to refuse collection of any items reasonably believed not to belong to the Customer or to have been unlawfully disposed of.
11. Complaints and Disputes
11.1 If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Collection Shoreditch as soon as possible, providing full details of the issue.
11.2 Waste Collection Shoreditch will investigate complaints and aim to respond within a reasonable timeframe. The Customer agrees to provide any further information or evidence reasonably requested to help resolve the matter.
11.3 Where a dispute cannot be resolved directly between the parties, the Customer and Waste Collection Shoreditch may consider using mediation or another form of alternative dispute resolution before resorting to court proceedings.
12. Data Protection and Privacy
12.1 Waste Collection Shoreditch will process personal data provided by the Customer in connection with bookings and the provision of Services in accordance with applicable UK data protection laws.
12.2 Personal data may be used to manage bookings, take payment, provide services, communicate with the Customer, improve operations, and comply with legal obligations. It may be shared with third party service providers where necessary to deliver the Services, process payments, or meet regulatory requirements.
13. Force Majeure
13.1 Waste Collection Shoreditch shall not be in breach of these Terms and Conditions or otherwise liable for a delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to extreme weather, fire, flood, strike, lock-out, industrial dispute, pandemic, civil unrest, road closures or vehicle breakdown where not caused by negligence.
14. Variation of Terms
14.1 Waste Collection Shoreditch may amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of the change.
14.2 For ongoing or contract-based Services, any material changes to these Terms and Conditions will be notified to the Customer in advance where reasonably practicable.
15. Severability
15.1 If any provision or part-provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision or part-provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
16. Entire Agreement
16.1 These Terms and Conditions, together with any written confirmation of booking and any agreed variations, constitute the entire agreement between the Customer and Waste Collection Shoreditch in relation to the Services and supersede any prior discussions, correspondence or understandings.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including non-contractual disputes or claims.
By confirming a booking or using the Services of Waste Collection Shoreditch, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
